1. Postępowanie o udzielenie zamówienia publicznego prowadzone jest w trybie przetargu nieograniczonego, na podstawie inż. 132 ustawy z dnia 11 września 2019 r. Prawo zamówień publicznych (Dz. U. z 2026 r., poz. 793), zwanej dalej „ustawą Pzp”, przepisów wykonawczych wydanych na jej podstawie oraz Kodeksu Cywilnego. W zakresie nieuregulowanym niniejszą SWZ, zastosowanie mają przepisy ustawy Pzp. 2. Zamawiający, zgodnie z art. 139 ustawy Pzp , przewiduje odwróconą kolejność czynności, tj. może najpierw dokonać badania i oceny ofert, a następnie dokonać kwalifikacji podmiotowej Wykonawcy, którego oferta została najwyżej oceniona, w zakresie braku podstaw wykluczenia oraz spełniania warunków udziału w postępowaniu. 3. Zakres rzeczowy przedmiotu zamówienia został opisany w Załączniku nr 9 do SWZ. 4. Wykonawca zobowiązany jest zrealizować zamówienie na zasadach i warunkach opisanych w Projektowanych postanowieniach umowy stanowiących Załącznik nr 8 SWZ. 5. Zamawiający unieważni postępowanie na podstawie art. 257 pzp w przypadku nieprzyznania środków na sfinansowanie zamówienia.[E31]
