A presente contratação de empresa especializada na prestação de serviços continuados de fornecimento de gases medicinais (com destaque para o Oxigênio Medicinal), na modalidade de fornecimento parcelado, sob o regime de comodato dos cilindros/recipientes necessários, para atender às demandas da Secretaria de Saúde do Município de Lafaiete Coutinho. Justifica pelo dever constitucional e legal de garantir o acesso universal e igualitário às ações e serviços de saúde, conforme preceitua a Lei Orgânica da Saúde (Lei nº 8.080/1990). O oxigênio medicinal é um insumo farmacêutico ativo essencial e indispensável para o funcionamento das unidades de saúde da rede municipal (como postos de saúde, unidades básicas ou serviços de atendimento de urgência/emergência, conforme aplicável). Sua utilização é vital para: • Atendimento a pacientes com insuficiência respiratória aguda ou crônica; • Suporte em procedimentos de emergência e estabilização de pacientes em estado crítico; • Manutenção da assistência terapêutica contínua aos munícipes que dependem da rede pública de saúde. A descontinuidade ou falta desse insumo acarreta risco iminente de dano irreparável à vida e à integridade física dos pacientes, configurando situação de extrema gravidade e urgência sanitária. O fornecimento na modalidade parcelada justifica-se pela própria natureza do consumo, que ocorre de forma contínua e flutuante ao longo do exercício financeiro. • Otimização do espaço físico e segurança: Os gases medicinais possuem exigências rígidas de armazenamento e prazos de validade técnicos.
