Die Stadt Schrobenhausen ist Eigentümerin des Freibads Schrobenhausen, Thaddäus-Siber-Straße 3, 86529 Schrobenhausen. Die Stadt Schrobenhausen beabsichtigt, im Rahmen dieses Vergabeverfahrens die Betriebsführung für das Bad für die Saison 2026 (15. Mai 2026 bis 15. September 2026) mit einmaliger Verlängerungsoption für die Saison 2027 (15. Mai 2027 bis 15. September 2027) an einen Auftragnehmer zu vergeben. Außerdem kann die Stadt optional Ein- und/oder Auswinterungsleistungen beauftragen. Die Aufteilung in eine fest beauftragte Saison (Saison 2026) eine Verlängerungsoption (Saison 2027) ergibt sich daraus, dass der Auftraggeber perspektivisch seinen eigenen Personalstamm vergrößern und das Bad ohne fremdvergebene Betriebsführungsleistungen betreiben möchte. Ob und wann dies möglich ist, ist derzeit nicht im Einzelnen vorhersehbar. Eigenes Personal der Stadt Schrobenhausen ist vorhanden. Diese sind an den öffentlichen Tarifvertrag TVöD gebunden und sollen in der Zeit von 15. Mai – 15. September 2026 (d. h. regulär 124 Betriebstage) dem Auftragnehmer überlassen werden (Personalgestellung). Es handelt sich voraussichtlich um: • 1 Schwimmmeister in Vollzeit • 2 Rettungsschwimmer in Vollzeit. Die Einsatzstunden sowie wie das Eigenpersonals der Stadt Schrobenhausen sind vom Auftragnehmer in den Freibadbetrieb zu integrieren (dies wären mit oben genanntem Personalbesatz 450 Stunden). Zwischen der Stadt Schrobenhausen und dem Auftragnehmer ist in diesem Zusammenhang ein Arbeitnehmerüberlassungsvertrag zu schließen.
