About the requirement

Työikäisten toimintakyvyn ja osallisuuden tuen palvelu on sosiaalihuoltolain mukainen tavoitteellinen palvelukokonaisuus, jonka tarkoituksena on vahvistaa henkilön itsenäistä selviytymistä, sosiaalista vuorovaikutusta ja mahdollisuuksia osallistua yhteiskunnan toimintoihin. Palvelu on tarkoitettu henkilöille, joiden toimintakyvyssä on rajoitteita ja osallisuuden esteitä, eivätkä he pysty osallistumaan muihin julkisiin työvoimapalveluihin. Toimintakyky on alentunut vamman, sairauden tai muun elämäntilanteen vuoksi tavalla, joka estää yhdenvertaisen osallisuuden toteutumisen. Tarjoajan tulee tarjota asiakkaalle työtoimintapaikan sisältäen soveltuvat työtehtävät, tarvittavan ohjauksen ja välineet sekä turvalliset työtilat. Ehdotettavassa lainsääntelyssä (HE180/2026 vp, sosiaalihuoltolain 17 §:n yksityiskohtaiset perustelut) mahdollisuutta tuottaa työtoimintaa hyvinvointialueelle ei sidottaisi palveluntuottajan oikeudelliseen muotoon. Sen sijaan sama tavoite toteutettaisiin säätämällä työtoiminnan toteuttamista koskevista reunaehdoista. Arvioinnissa ratkaisevaa ei siten olisi, tuottaako työtoiminnan hyvinvointialue, yhdistys, säätiö vai yritys, vaan se, käytetäänkö työtoimintaa korvaamaan sellaista työtä tai palvelua, joka muutoin toteutettaisiin vastiketta vastaan. (Ks palvelunkuvaus) Toimintakyvyn ja osallisuuden tuen palvelu perustuu sosiaalihuoltolain 17 §:ään ja hallituksen esitykseen HE 180/2026 vp laiksi sosiaalihuoltolain muuttamisesta ja siihen liittyviksi laeiksi.
