From the notice

Przedmiotem zamówienia jest zakup usługi wsparcia wytwórstwa oprogramowania autorskiego - Body Leasing. Szczegółowy opis przedmiotu zamówienia (OPZ), został zawarty w Projektowanych postanowieniach umowy stanowiących Załącznik nr 2 do SWZ. 1. Na podstawie art. 16 b ust. 2 ustawy Zamawiający informuje, że nie dopuszcza ofert z udziałem usług pochodzących z państw trzecich, tj. z państw niebędących państwami członkowskimi Unii Europejskiej lub państwami, z którymi Unia Europejska zawarła umowy gwarantujące na zasadzie wzajemności i równości dostęp do rynku zamówień publicznych, o których mowa w art. 16a ustawy. Oferta zawierająca taką usługę zostanie odrzucona na podstawie art. 226 ust. 1 pkt 5 ustawy jako niezgodna z SWZ. 2. W celu oceny, czy oferta podlega odrzuceniu, o którym mowa w pkt. 1, Zamawiający zbada pochodzenie usługi na podstawie pochodzenia świadczącego ją Wykonawcy/podmiotu. 3. Zamawiający wyjaśnia, że w niniejszym postępowaniu poprzez usługę pochodzącą z państw trzecich rozumie: 3.1. świadczenie kompleksowych usług dotyczących: wytwarzania, modernizacji aplikacji dziedzinowych Zakładu, poprawy jakości kodu źródłowego, wsparcia eksperckiego w zakresie analizy systemowej projektowanych, wytwarzanych albo zmienianych aplikacji, wsparcia eksperckiego w zakresie testowania wytwarzanych albo zmienianych aplikacji, wsparcia eksperckiego w zakresie wytwarzania albo edycji dokumentacji projektowej aplikacji, organizacji prac w roli Scrum Master po stronie Wykonawcy zamówienia, polegających na wytwarzaniu, modernizacji aplikacji dziedzinowych wraz z niezbędną dokumentac…[E7]
